Data Protection Policy

Personal data (hereinafter mostly referred to as »data«) is processed by us only within the scope of necessity and for the purpose of providing a functional and user-friendly internet presence, including its contents and the services offered there.

Pursuant to Article 4(1) of Regulation (EU) 2016/679, i.e. the basic regulation on data protection (hereinafter referred to as the »GDPR«), »processing« means any operation or set of operations which is conducted with or without the assistance of automated procedures and which involves personal data, such as collection, recording, organisation, sorting, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, comparison or association, restriction, erasure or destruction.

The following data protection policy informs you in particular about type, extent, purpose, duration and legal basis of the processing of personal data, as far as we decide either alone or together with others about the purposes and means of the processing. In addition, we also inform you in the following about the third-party components used by us for optimisation purposes and to increase the quality of use, should third parties process data on their own responsibility.

II. Rights of users and data subjects

With regard to the data processing described in more detail as follows, users and data subjects are entitled to

  • confirmation as to whether data relating to them is to be processed, information on the data processed, further information on the data processing and copies of the data (cf. also Art. 15 GDPR);
  • correction or completion of inaccurate or incomplete data (cf. also Art. 16 GDPR);
  • immediate deletion of the data relating to them (cf. also Art. 17 GDPR) or, alternatively, should further processing be required pursuant to Art. 17 para. 3 GDPR, to the restriction of processing pursuant to Art. 18 GDPR;
  • receive the data relating to them and provided by them and to transmit these data to other providers/responsible persons (cf. also Art. 20 GDPR);
  • submit a complaint to the supervisory authority should they be of the opinion that the data concerning them are being processed by the provider in breach of data protection provisions (cf. also Art. 77 GDPR).

In addition, the provider is obliged to inform all recipients to whom data have been disclosed by the provider of any rectification or deletion of data or of the restriction of processing which takes place pursuant to Articles 16, 17 para. 1, 18 GDPR. However, this obligation is not applicable should this notification be impossible or involves disproportionate effort. Irrespective of this, the user has a right to information about these recipients.

Users and data subjects also have the right under Art. 21 GDPR to object to the future processing of data concerning them, provided the data are processed by the provider in accordance with Art. 6 para. 1 lit. f) GDPR. In particular, an objection to data processing for the purpose of direct marketing is admissible.

III. Information on data processing

Your data processed when using our website is deleted or blocked as soon as the purpose of storage no longer applies, the deletion of the data is not opposed by any legal storage obligations and no other information on individual processing methods is subsequently provided.


Server data

Data is transmitted to us or to our web space provider via your internet browser for technical reasons, in particular to ensure a secure and stable internet presence. These so-called server log files enable i.a. the collection of the type and version of your internet browser, the operating system, the website from which you switched to our internet presence (referrer URL), the pages of our internet presence visited by you, the date and time of the respective access and the IP address of the internet connection from which the use of our internet presence takes place.

Data collected in this way are temporarily stored, but not together with your other data.

Legal grounds for storage is on the basis of Art. 6 para. 1 lit. f) GDPR. Our legitimate interest lies in the improvement, stability, functionality and security of our internet presence.

Data is deleted after seven days at the latest, unless further storage is required for purposes of providing evidence. Data is otherwise wholly or partially excluded from deletion until the incident is finally resolved.


Cookies

a) Session cookies

We use so-called cookies with our internet presence. Cookies are small text files or other storage technologies that are stored on your terminal device by the internet browser you use. These cookies process certain information from you relating to an individual extent, such as your browser or location data or your IP address.

This processing ensures our internet presence is more user-friendly, more effective and safer, as the processing makes it possible, for example, to reproduce our internet presence in different languages.

The legal basis for this processing is Article 6 para. 1 lit b.) GDPR, to the extent these cookies are used to process data for contract initiation or contract execution.

Should the processing not serve the contract initiation or contract execution, our legitimate interest lies in improving the functionality of our website. Legal grounds for storage is then provided by of Art. 6 para. 1 lit. f) GDPR.

These session cookies are deleted when you close your internet browser.

b) Third-party cookies

If necessary, cookies from partner companies in cooperation with us may also be used for the purpose of advertising, analysis or the functionalities of our internet presence.

c) Removal option

It is possible to prevent or restrict the installation of cookies by setting your internet browser. Similarly cookies that have already been saved at any time may also be deleted. The steps and measures required for this depend however on the internet browser being used. In the case of so-called flash cookies, however, processing cannot be prevented via the browser settings. Instead, the setting of your flash player needs to be changed. Contact enquiries/Contact options

Should you contact us via contact form or email, the data you provide is used to process your enquiry. The data is needed to process and respond to your enquiry – we cannot answer your enquiry otherwise, or at least only to a limited extent.

The legal basis for this processing is Article 6 para. 1 lit. b) GDPR.

Your data is deleted when your request is conclusively answered and there are no legal obligations to retain data to prevent deletion, e.g. in the event of any subsequent contract processing.


Google Analytics

Google Analytics is used on our website. This is a web analysis service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter referred to as »Google«.

Certification according to the EU-US data protection sign

ensures the data protection requirements of the EU are also complied with by Google when processing data in the USA.

The Google Analytics service is used to analyze the usage behavior of our internet presence. The legal basis for this processing is Article 6 para. 1 lit. f) GDPR. Our legitimate interest lies in the analysis, optimisation and economic operation of our internet presence.

Usage and user-related information, such as IP address, location, time or frequency of visits to our website, is transmitted to a Google server in the USA and stored there. Google Analytics however applies the so-called anonymization function. This function shortens the IP address already inside the EU or EEA.

The data collected in this way is in turn used by Google to provide us with an evaluation of the visit to our website and the usage activities there. This data may also be used to provide other services related to the use of our website and the use of the internet.

Google undertakes not to associate your IP address with any other data.
In addition Google provides further data protection information for you at https://www.google.com/intl/de/policies/privacy/partners, for example on the possibilities of prohibiting the use of data.

Also Google offers a so-called deactivation add-on at https://tools.google.com/dlpage/gaoptout?hl=de along with further related information. When this add-on is installed with standard internet browsers it offers you further control over the data collected by Google visiting our website. The add-on informs the JavaScript (ga.js) of Google Analytics that information on visiting our website should not be transmitted to Google Analytics. However, this does not prevent information from being transmitted to us or to other web analysis services. This data protection policy of course also explains whether and which other web analysis services are used by us.


YouTube

YouTube is used on our website where applicable. This is a video portal of YouTube LLC, 901 Cherry Ave, 94066 San Bruno, CA, USA, hereinafter referred to as »YouTube«.

YouTube is a subsidiary of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter referred to as »Google«.

Certification according to the EU-US data protection sign
(»EU-US Privacy Shield« – https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active) ensures the data protection requirements of the EU are also complied with by Google and subsequently its subsidiary YouTube when processing data in the USA.

We use YouTube in conjunction with the »Advanced Privacy Mode« feature to display videos to you if required. The legal basis for this processing is Article 6 para. 1 lit. f) GDPR. Our legitimate interest lies in improving the quality of our internet presence. According to YouTube the function »extended data protection mode« means that the data described in more detail as follows is only transmitted to the YouTube server when a video is actually started.

When the »Extended Privacy Policy« is not used then a connection is established to the YouTube server in the United States as soon as you access one of our web pages that embeds a YouTube video.

The connection is required in order to display the respective video on our website via your internet browser. In the course of this YouTube at least records and processes your IP address, the date and time as well as the website you visited. It also connects to the Google »DoubleClick« advertising network.

Should you be logged in to YouTube at the same time, YouTube assigns the connection information to your YouTube account. Should you wish to prevent this, you need to either log out of YouTube before visiting our website or make the appropriate settings in your YouTube user account.

YouTube permanently stores cookies on your terminal device via your internet browser for the purpose of functionality and analysis of user behaviour. Should you not agree with this processing, you have the option of preventing the cookies from being stored by adjusting the settings in your internet browser. Vimeo

We use the provider Vimeo for the integration of videos - e.g. in our moving image work examples. Vimeo is provided by Vimeo, LLC headquartered at 555 West 18th Street, New York, New York 10011.

We use plugins of the provider Vimeo on some of our internet pages. Should you retrieve the internet pages of our internet presence with such a plugin – for example our media library – a connection to the Vimeo servers is established and the plugin is displayed. When doing so, the Vimeo server is informed of our internet pages visited. When you log in as a member of Vimeo, Vimeo assigns this information to your personal user account. When using the plugin, e.g. clicking the start button of a video, this information is also assigned to your user account. This assignment is prevented by logging out of your Vimeo user account before using our website and deleting the corresponding cookies from Vimeo.

Our Instagram page

The data processing information described below relates to the operation of our Instagram page https://instagram.com/biikeonfire.

Instagram is a service that qualifies as an audiovisual platform that enables users to share photos and videos and also to disseminate such data on other social networks.

The provider of Instagram services is Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland.

When you are logged into Instagram during a visit to our Instagram page, your activities there are assigned to your Instagram account and stored and processed by Instagram. This association is prevented by logging out of your Instagram user account before using our Instagram page.

Insights

Facebook provides us with statistical data about visitors to our Facebook page via the ‘Insights’ function. It is not possible to assign them to a specific person. An analysis of the use of our site is undertaken with the help of this function and it is adapted to the needs and interests of our visitors. Facebook processes personal data in relation to this function.

Interaction

We see when a particular Facebook user clicks or subscribes to our Facebook page. We are also able to assign comments and likes to posts on our Facebook page to individual users.

Monitoring

We check the content of comments on our Facebook page ourselves. All comments are searched for inappropriate content. The Facebook profile posting a specific comment is also evident. We also see the content of the comment, the timestamp of its creation, the author User ID and Facebook username, and any reference to the author's previous posts or comments. A check may result in the concealment of a comment or the blocking of a user. The legal basis is Article 6 I f) GDPR. Our legitimate interest lies in ensuring the content provided by us is not associated with inappropriate comments and that criminal offences (e.g. insults) are prevented.

Contact us via our Facebook page

Various possibilities to contact us for specific purposes are available on our Facebook page. We use the data transmitted to us in this way solely for the purpose of processing your request. Messages received by us are deleted at the latest after completion of the request, unless storage is necessary for other reasons.

This data protection policy was created on the basis of the sample data protection policy of the law firm Anwaltskanzlei Weiß & Partner and has been supplemented and adapted to the best of our knowledge to the technical facts and specifications of our website and other online offers used or integrated by us.
